How Can I Kick My Wife or Husband Out of the House? Question: How can I kick my wife or husband out of the house in California? Answer: California family law requires a showing of assault or threatened assault if the request is made on an emergency basis or the potential for physical or emotional harm if the request is made on a non- emergency basis. A divorce may be inevitable. Living with your spouse may be unbearable. But how can you kick your spouse (wife or husband) out of the house and do so legally?
In California family law cases, these “kick out” requests (called residency or dwelling exclusions) are granted if the spouse who seeks it meets certain minimum requirements. What are these requirements to kick out your husband or wife? That partly depends on whether you want the order on an emergency basis or not. Let’s take a look at California law. This article isn’t legal advice about your specific case or facts. How can I kick my wife or husband out of the house on an emergency basis? California Family Code 6. The court may issue an ex parte order excluding a party from the family dwelling, the dwelling of the other party, the common dwelling of both parties, or the dwelling of the person who has care, custody, and control of a child to be protected from domestic violence for the period of time and on the conditions the court determines, regardless of which party holds legal or equitable title or is the lessee of the dwelling. So what is require to get an emergency order to kick out your spouse? Family Code 6. 32. Facts sufficient for the court to ascertain that the party who will stay in the dwelling has a right under color of law to possession of the premises.(2) That the party to be excluded has assaulted or threatens to assault the other party or any other person under the care, custody, and control of the other party, or any minor child of the parties or of the other party.(3) That physical or emotional harm would otherwise result to the other party, to any person under the care, custody, and control of the other party, or to any minor child of the parties or of the other party. Since our family law firm handles cases in Orange County, California, let’s also take a look at Orange County Family Law local rule 7. E). This states: A temporary restraining order prohibiting a party from the use of the family home will not be granted on an ex parte basis unless the request is supported by a declaration(s) by a witness setting forth a factual basis showing immediate and serious harm. When you are unmarried the question arises in mind when will I get married or when the marriage will get settled. Being an astrologer I am answering this question. How to identify a narcissist, narcissism in relationships, married to a narcissist, signs your partner is an abusive narcissist. The declaration(s) must state, in detail, the time and place of the act(s) and the exact injuries suffered by the moving party. Kicking a spouse out of the house due to threatened or actual assault can be done on an emergency basis. What does “right under color of law to possession” mean? It first means that our California legislature needs to use more simple English when writing laws. But unfortunately this term is not even defined by this code section. Being on title or a lease is enough but what if the spouse has just been living there even though they don’t have either? The law is not clear although we believe most judges would find this right to possession if a husband and wife have lived in a home or apartment together, regardless of whether they own or lease it together. As you can read from the law, these kick out orders on an emergency basis are not easy to get. The words “assaulted” or “threatens to assault” means the court will consider such requests when there is threatened violence or actual violence. In Orange County, the judge also needs a showing of “immediate and serious harm” and, in our experience, the assault or threat has to be recent. How recent depends on the facts and the nature and extent of the threats or assault. Recent may mean days, weeks or even months before depending on the case. Think about this like any other request you may put in front of the court. The court may believe you and a he said, she said situation may be enough. Or the Court may want more. The more you have, the better the chance the court will grant it. This may include witnesses, photos, videos and other objective evidence. What about a non- emergency basis for kicking a spouse out of the house? Kicking a husband or wife out of the house is not as difficult if the request for the order is filed on a non- emergency basis. California Family Code 6. Court needs to find physical harm or emotional harm would result if the order is not granted. This can include harm to the person making the request, to the child or children or to anyone else under the person’s care, custody and control. Notice there is mandatory need to show “assault” or “threatened assault.”Do you want to kick your husband or wife out of the house or are you facing such a request from your spouse? Don’t ever handle these types of matters on your own. A family law attorney’s experience is important. This article is not legal advice. Whether you have proper grounds to seek such a kick out order or whether you can successfully defend one will require an attorney’s advice and analysis of your specific facts. A baseball park, also known as a ballpark or diamond, is a venue where baseball is played. A baseball park consists of the playing field and the surrounding spectator seating. While the diamond and the areas denoted by white painted lines adhere to strict rules, guidelines for the rest of the field are flexible. The term . The infield is a rigidly structured diamond of dirt containing the three bases, home plate, and the pitchers mound. The space between the bases and home is normally a grass surface, save for the dirt mound in the center. Some ballparks, like Toronto's Rogers Centre, have grass or artificial turf between the bases, and dirt only around the bases and pitcher's mound. Others, such as Koshien Stadium in Hy. These are the foul lines or base lines, usually differentiated by referring to them as the first base line, or the third base line. If a ball hit by the batter lands outside of the space between these two lines, or rolls out of this space before reaching first or third base, the ball is . If it lands between or on the lines, it is . At the end of the lines are two foul poles, which help the umpires judge whether a ball is fair or foul. Behind home is the catcher's box, where the catcher and the home plate umpire stand. Next to first and third base are two coaches' boxes, where the first and third base coaches guide the baserunners, generally with gestures or shouts. As the baserunner faces away from the outfield when running from second base to third, they cannot see where the ball is, and must look to the third base coach on whether to run, stop, or slide. Farther from the infield on either side are the dugouts, where the teams and coaches sit when they're not on the field. They are named such because, at the professional levels, this seating is below the level of the playing field so as to not block the view from prime spectator seating locations. In amateur parks, the dugouts may be above- ground wooden or CMU structures with seating inside, or simply benches behind a chain link fence. Beyond the infield and between the foul lines is a large grass outfield, generally twice the depth of the infield. The playing field is bordered by fences of varying height. The infield fences are in foul territory, and a ball hit over them isn't a home run; consequently, they are often lower than the outfield fences to provide a better view for spectators. Sometimes, the outfield fence is made higher in certain areas to compensate for a close proximity to the batter. In professional parks, the field is surrounded by an area roughly 1. Originally used in Yankee Stadium in 1. This change in terrain warns a fielder, who is watching a ball in the air, that the wall is near, avoiding possible injury. Beyond the outfield fence in professional parks is an area called the batter's eye. To ensure the batter can see the white ball, the batter's eye contains no seating, and is a darker color. This can be anything from a dark wall to a grassy slope. Seating. How far this seating extends down the baselines or around the foul poles varies from park to park. In minor league parks, the grandstands are notably smaller, proportional to expected sizes of crowds compared with the major leagues. The seating beyond the outfield fence generally differs from the grandstand, though some multi- purpose or jewel box parks have the grandstand surround the entire field. This area could contain inexpensive bleacher seats, smaller grandstands, or simply inclined seating. In local ballparks, there are often simply a set or two of aluminum bleachers on the first- base and third- base sides. Variations. Like its English relative, cricket, there is significant flexibility in the shape and size of the rest of the playing area. Generally, the higher the skill level, the deeper the minimum dimensions must be, to prevent an excess of home runs. In the major leagues, a rule was passed in 1. This rule was passed to avoid situations like the Los Angeles Coliseum, which was 2. Since the opening of Camden Yards, many other . These distances vary from park to park, and can even change drastically in the same park. One of the most famous examples is the original Yankee Stadium, whose odd- shaped plot of land caused right field to be over 1. The rectangular Polo Grounds had extremely short distance down the lines, 2. In contrast, the deepest part of center field was nearly 5. Also, new parks have sometimes received special dispensation to deviate from these rules. Today's Best Free Porn Videos, Free Sex Movies, Sex Tube Videos & Movies. Ballparks may have round swooping fences or rigidly angles fences, or possibly a significant change in direction or irregular angle. For example, the center field stands and the left field stands at Fenway Park meet at an uneven angle, creating an indentation (called . In Citi Field and AT& T Park, part of the right field fence juts unevenly into the outfield as if the builders were trying to create an unpredictable ricochet effect for balls hit against it. If there was a street beyond left field, the distance to the left field fence would be shorter, and if the distance was too short, the fence would be higher. For example, in the old Griffith Stadium in Washington, D. C., part of center field had to be built around a cluster of apartment houses and the result was a rather large angular indentation in the left- center field fence. The genesis of modern baseball is conventionally connected with Elysian Fields in Hoboken, New Jersey. The last surviving major league . As college football gained in popularity, the smaller college playing fields and/or running tracks (which also frequently had the suffix . Major league baseball enjoyed a similar boom. The official names of those arenas also often included the word . The retro era of the 1. Safeco Field and Miller Park. There is little consistency in the choice between . For example, Houston's Minute Maid Park was originally named . Seating area design is affected by many variables, including required capacity, audience access, and road traffic. Early ballparks like Elysian Fields were far from the city center. Each game was an event, and fans traveled by public transit to watch the game. With the growth of professional leagues, and consequent growth in the quantity of games, each game became less of an event, and fan convenience became more important. Consequently, the classic ballparks typically had little space for automobiles, as it was expected that most fans would take mass transit to the games, a situation that still prevails at Boston's Fenway Park and Chicago's Wrigley Field, for example. Some early ballparks, such as Brooklyn's Eastern Park, were abandoned because the trolley lines did not go out far enough and the team was not performing well enough for people to tolerate the inconvenience. As fans became more affluent, and especially as they moved to the suburbs and bought cars, the lack of parking became an important issue. Some ballparks remedied this problem through the construction of parking garages in the vicinity, or building new ballparks with ample parking. Others built ballparks in the suburbs, typically with large parking areas. The ballpark/stadium thus became an . Although known for being constructed out of wood, they featured iron columns for better support. Some included one tier of inclined seating, topped with either a flat roof or, in some instances, a small upper tier. The outfield was bordered by tall walls or fences covered in advertisements, much like today's minor league parks. These advertisements were sometimes fronted with bleacher seats, or . Wood, while prone to decomposition, was a relatively inexpensive material, as there was no official governing body for professional baseball at the time. However, the use of wood as the primary material presented a major problem, especially as baseball continued to thrive. Over time, the wooden stands aged and dried. Many parks caught fire, and some were leveled completely. This problem, along with the popularization of baseball and expectations for long- term use of the parks were major factors that drove the transition to the new standard materials for ballparks: steel and concrete. Others were simply abandoned in favor of new structures built elsewhere. These new fire- resistant parks often lasted for many decades, and (retrospectively) came to be known as . Now residential. The field lines of a vector field. F through surfaces with unit normal n, the angle from n to F is . Flux is a measure of how much of the field passes through a given surface. F is decomposed into components perpendicular (. Only the parallel component contributes to flux because it is the maximum extent of the field passing through the surface at a point, the perpendicular component does not contribute. Top: Three field lines through a plane surface, one normal to the surface, one parallel, and one intermediate. Bottom: Field line through a curved surface, showing the setup of the unit normal and surface element to calculate flux. Flux is either of two separate simple and ubiquitous concepts throughout physics and applied mathematics. Within a discipline, the term is generally used consistently, but care must be taken when comparing phenomena from different disciplines. Both concepts have mathematical rigor, enabling comparison of the underlying math when the terminology is unclear. For transport phenomena, flux is a vector quantity, describing the magnitude and direction of the flow of a substance or property. In electromagnetism, flux is a scalar quantity, defined as the surface integral of the component of a vector field perpendicular to the surface at each point. As will be made clear, the easiest way to relate the two concepts is that the surface integral of a flux according to the first definition is a flux according to the second definition.
Terminology. The specific quote from Maxwell is: In the case of fluxes, we have to take the integral, over a surface, of the flux through every element of the surface. The result of this operation is called the surface integral of the flux. It represents the quantity which passes through the surface.— James Clerk Maxwell. According to the first definition, flux may be a single vector, or flux may be a vector field / function of position. In the latter case flux can readily be integrated over a surface. By contrast, according to the second definition, flux is the integral over a surface; it makes no sense to integrate a second- definition flux for one would be integrating over a surface twice. Thus, Maxwell's quote only makes sense if . This is ironic because Maxwell was one of the major developers of what we now call . Their names in accordance with the quote (and first definition) would be . This implies that Maxwell conceived as these fields as flows/fluxes of some sort. Given a flux according to the second definition, the corresponding flux density, if that term is used, refers to its derivative along the surface that was integrated. By the Fundamental theorem of calculus, the corresponding flux density is a flux according to the first definition. Given a current such as electric current—charge per time, current density would also be a flux according to the first definition—charge per time per area. Due to the conflicting definitions of flux, and the interchangeability of flux, flow, and current in nontechnical English, all of the terms used in this paragraph are sometimes used interchangeably and ambiguously. Concrete fluxes in the rest of this article will be used in accordance to their broad acceptance in the literature, regardless of which definition of flux the term corresponds to. Flux is the application architecture that Facebook uses for building client-side web applications. It complements React's composable view components by utilizing a. Arbuthnot By the perpetual. Define flux: a series of changes : continuous change — flux in a sentence. Flux is the presence of a force field in a specified physical medium, or the flow of energy through a surface. In electronics, the term applies to any electrostatic. Flux as flow rate per unit area. For example, the magnitude of a river's current, i. Each is a special case of the following. In all cases the frequent symbol j, (or J) is used for flux, q for the physical quantity that flows, t for time, and A for area. These identifiers will be written in bold when and only when they are vectors. First, flux as a (single) scalar: j=IA. The surface is assumed to be flat, and the flow is assumed to be everywhere constant with respect to position, and perpendicular to the surface. Second, flux as a scalar field defined along a surface, i. However the flow need not be constant. Rather than measure the total flow through the surface, q measures the flow through the disk with area A centered at p along the surface. Finally, flux as a vector field: j(p)=. I is defined picking the unit vector that maximizes the flow around the point, because the true flow is maximized across the disk that is perpendicular to it. The unit vector thus uniquely maximizes the function when it points in the . For example, the argmax construction is artificial from the perspective of empirical measurements, when with a Weathervane or similar one can easily deduce the direction of flux at a point. Rather than defining the vector flux directly, it is often more intuitive to state some properties about it. Furthermore, from these properties the flux can uniquely be determined anyway. If the flux j passes through the area at an angle . This is, the component of flux passing through the surface (i. The only component of flux passing normal to the area is the cosine component. For vector flux, the surface integral of j over a surface. S, gives the proper flowing per unit of time through the surface. The relation is A=An^. Unlike in the second set of equations, the surface here need not be flat. Finally, we can integrate again over the time duration t. Used in astronomy to determine the magnitude and spectral class of a star. Also acts as a generalization of heat flux, which is equal to the radiative flux when restricted to the infrared spectrum. Energy flux, the rate of transfer of energy through a unit area (J. The radiative flux and heat flux are specific cases of energy flux. Particle flux, the rate of transfer of particles through a unit area (. Also, one can take the divergence of any of these fluxes to determine the accumulation rate of the quantity in a control volume around a given point in space. For incompressible flow, the divergence of the volume flux is zero. Chemical diffusion. The rings show the surface boundaries. The red arrows stand for the flow of charges, fluid particles, subatomic particles, photons, etc. The number of arrows that pass through each ring is the flux. General mathematical definition (surface integral). Also, the surface has to be actually oriented, i. Lines originate from areas of positive divergence (sources) and end at areas of negative divergence (sinks). See also the image at right: the number of red arrows passing through a unit area is the flux density, the curve encircling the red arrows denotes the boundary of the surface, and the orientation of the arrows with respect to the surface denotes the sign of the inner product of the vector field with the surface normals. If the surface encloses a 3. D region, usually the surface is oriented such that the influx is counted positive; the opposite is the outflux. The divergence theorem states that the net outflux through a closed surface, in other words the net outflux from a 3. D region, is found by adding the local net outflow from each point in the region (which is expressed by the divergence). If the surface is not closed, it has an oriented curve as boundary. Stokes' theorem states that the flux of the curl of a vector field is the line integral of the vector field over this boundary. This path integral is also called circulation, especially in fluid dynamics. Thus the curl is the circulation density. We can apply the flux and these theorems to many disciplines in which we see currents, forces, etc., applied through areas. Electromagnetism. The amount of air moving through the net at any given instant in time is the flux. If the wind speed is high, then the flux through the net is large. If the net is made bigger, then the flux is larger even though the wind speed is the same. For the most air to move through the net, the opening of the net must be facing the direction the wind is blowing. If the net is parallel to the wind, then no wind will be moving through the net. The simplest way to think of flux is . This is a consequence of Gauss's Law applied to an inverse square field. The flux for any cross- sectional surface of the tube will be the same. The total flux for any surface surrounding a charge q is q/. The quantity arises in Faraday's law of induction, in integral form. The direction is such that if current is allowed to pass through the wire, the electromotive force will cause a current which . This is the basis for inductors and many electric generators. Poynting flux. This is commonly used in analysis of electromagnetic radiation, but has application to other electromagnetic systems as well. Confusingly, the Poynting vector is sometimes called the power flux, which is an example of the first usage of flux, above. An Etymological Dictionary of Modern English. Courier Dover Publications. Shadow people are dark, human shapes typically seen moving at night and the most common form of ghosts that people witness. Shadow people often flee in the presence of people in physical bodies, especially if they realize they have been detected, and are often viewed out of the corner of one’s eye (peripheral vision). Shadow people are also known as dark shadows or shadow ghosts and probably are the most misunderstood of ghost entities. Shadow is an indication of spiritual condition: it is the absence of light (light in spirituality denotes truth - and darkness would indicate a lack of knowing or fear). In other words, shadow people are disembodied humans who are lost, having not gone forward in life’s journey by refusing to go toward the light that will carry them fully unto the next realm after death of the physical body. Missing this transition, ghosts remain here with those of us on Earth in a temporary state of limbo, so to speak. Shadow ghosts are not devils, demons or aliens, as some want to theorize, but people; and how they look to us is most likely due to two factors: their inner condition (state of the soul)how we are able to perceive them in the visible spectrum. Because we fear darkness, many of us have come to believe that shadow people have ill intentions and thus are evil. However, most shadow people are not negative in nature, and are simply lost and in need of guidance to understand their condition. Shadow people have been recorded in video as both adults and children, male and female, but often as people reliving their former lives, being trapped by the mind and remaining as earthbound spirits. Differing shadow forms have been witnessed of shadow people: big, small, with and without hats, hooded, and even as black mists of vapor (ectoplasm). Often times, shadow people have been seen beside people’s beds (Shadow People Ghost Story), most likely attempting to get a message to a loved one, or possibly as a plea for help. Shadow people are most often seen during the evening, preferring to hide under the cover of darkness. Perhaps this is why. If a person has decided to remain as an earthbound disincarnate having not gone unto the light upon their passing from the physical world, then it makes sense that they would continue to try and remain aloof by hiding in the shadows – darkness. Scripture suggests that ghosts, spirits, and any entities contacted from beyond the grave - are demons deceiving us. How to Find Inner Peace. Looking for inner happiness and peace? Inner peace means you have a sense of harmony, emotional well-being and fulfillment in your life. To see certain numbers in your dream provide encouragement (or discouragement) in an area of your waking life. Numbers reflect how or where you stand in some area of. Shadow people are not bound by walls or physical obstacles, as they may choose to move through them. Strangely, some shadow people seem to believe they have to go around physical objects and, perhaps, have not discovered that they can pass through things. The make- up of shadow people appears to be a dense, light- impenetrable, black static, mass of spirit. Flashlights reportedly will not shine through shadow people, and reports have been given of the shadow person becoming extremely frightened by the flashlight, or possibly, finding out that they were visible to those of us who are fortunate enough to see them. You can read more about this with the Moundsville Shadow Man account. Interestingly, some shadow people have been described as having red eyes. In some cases of haunting, it was found that evil- appearing shadow ghosts purposely altered their appearance to look non- human in order to frighten people. Richard Wetherill—who explored countless cliff dwellings across the Southwest, including Mesa Verde’s Cliff Palace—may. When the ghosts were confronted, horns and red- eyes did not remain after the ghosts knew they were no longer feared and being communicated with - this was especially true when conversations with the ghosts led to a spirit rescue. Also of note, shadow ghosts of animals have also been reported. Shadow people appear to be in a state of suffering, sometimes intense, fearing retribution or confrontation with others who they have wronged in life, or the idea of being condemned to an everlasting hell as punishment for past sins. It seems that sometimes shadow people just need our help in moving on beyond the physical world (their past). We feel it wise to note that some shadow people do have ill- intent, however, and willingly have chosen to remain earthbound – even unto attaching to (or, perhaps, possessing) another person. They are usually very adept at making their presence know, manipulating the environment and even altering their appearance. These mean- spirited, negative people still can be helped and do not fully understand that if they choose to move on unto the light, it will mean a healthier and happier existence for them. The personalities of shadow people, as mentioned previously, can vary from nice to nasty; not any different from people you will meet that are still in bodies! When a person passes, their mental and physical condition will not change until they move into the light with loved ones, as a life- review or cleansing process occurs. After the life- review, the spirits become “clean,” as mis- thinking is purged and truth and understanding is gained. Shadow people are therefore “unclean” spirits, and retain their emotional and physical baggage, so to speak. This will manifest as a distinct personality, mentality, ailment, pain, appearance, etc - and even odor, at times! Shadow people simply seem trapped in their former state and do not appear to advance in age, intellect, or in any aspect of their condition until they choose to turn to loved ones who are with them, who are attempting to bring them forward unto the light and life.
